Learned counsel for the appellant seeks permission of this Court to withdraw this appeal submitting that the appellant wishes to comply with the liberty granted to him by this Court by order dated 08.09.2021 in Cr.A. No. 548 of 2021.

In the earlier appeal filed by the appellant bearing No. CR.A. No. 548 of 2021, by order dated 08.09.2021, the appeal was dismissed as withdrawn and liberty was granted to the appellant to file appropriate application, before the Court below at appropriate stage on the basis of change in circumstances.

After considering on the submissions made by the learned counsel for the appellant, the present appeal is dismissed and disposed off as withdrawn with the liberty as prayed.
