1. The applicant has preferred this bail application for grant of bail as he is arrested in connection with Crime No.10/2017 registered at Police Station Premnagar, District Surajpur for offence under Sections 456, 354 & 506-B of the IPC and Sections 7 & 8 of the Protection of Children from Sexual Offences Act, 2012.

2. The applicant has allegedly outraged the modesty of the victim aged less than 16 years after committing lurking house trespass. After outraging the modesty, the applicant also criminally intimidated the victim.

3. In statement under Section 161 CrPC, the victim has stated that the act

was committed twice, however, in her statement under Section 164 CrPC, only one incident is narrated.

4. Considering the entirety of the circumstances as also for the reason that the applicant is in jail since 5.7.2017; investigation is complete as charger sheet has already been filed and there is no previous antecedents of the applicant, this Court is inclined to release him on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
