Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 01/03/2021 :

1. The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.1131/2020, registered at Police Station Sarkanda, District Bilaspur for offence punishable under Sections 120-B/34, 406, 408 and 420 of the IPC.

2. The applicant was an employee as well as supplier to the company M/s Rite Water Solutions (India) Private Limited, Ambajhari, Nagpur. The company was engaged in supplying Water ATM to different local bodies in the State of Chhattisgarh. The applicant instead of sending payments received from different local bodies to the company, retained the same by asking the local bodies to deposit the payments in his account or in the accounts opened by him in the name of his own firm or in the name of M/s Rite Water Solutions (India) Pvt Ltd.

3. Even if the applicant had some dispute regarding payment of salary or the payments concerning his transactions with the company, his act of fraudulently opening the account in the name of M/s Rite Water Solutions (India) Pvt Ltd or persuading the local bodies to make payments of the amounts in his account is an act attracting the offences alleged against the applicant.

4. Therefore, considering the nature of allegations, I am not inclined to extend the benefit of anticipatory bail to the applicant. Accordingly, the application is rejected.
