For State :
Mr. P. Acharya, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order on Board 09/09/2019
1. The challenge in the present writ petition is to the impugned order of transfer (Annexure P/1) dated 23.08.2019 whereby the services of the petitioner has been transferred from Bijapur to Rajnandgaon.
2. The contention of the petitioner is that he has got only around 1 1⁄2 years of service left before superannuation and at this juncture transferring the petitioner from one place to another would create great inconvenience to the petitioner. The further ground of challenge is that the petitioner in the impugned order of transfer has been shown as a Deputy Ranger, whereas the petitioner had already been promoted in the year 2018 on the post of Forest Ranger. For this
reason also, according to the petitioner, the impugned order does not seem to be passed on administrative exigency.
3. Given the aforesaid facts and circumstances of the case, let the petitioner make a detailed representation to the respondents within a period of 10 days from the date of receipt of the copy of this order and the respondents in turn shall decide the same within a further period of 45 days from the date of receipt of the representation.
4. Meanwhile, the effect and operation of the impugned order shall remain stayed, so far as the petitioner is concerned.
5. With the aforesaid observations, the present writ petition stands disposed off.
