The applicants have preferred this bail application under Section 439 CrPC, as they have been arrested in connection with Crime No.164/2017, registered at Police Station Chirmiri, District Korea for the offence punishable under Section 20 (B) of Narcotic Drugs and Psychotropic Substance Act.

The applicants were found to be possessed of illicit ganja weighing at 3.100 kgs. They are in jail since 06.05.2017. The concerned SHO has not reported any previous antecedent of the applicants being involved in committing similar nature of crime, although, there are some offences under the Public Gambling Act

and Chhattisgarh Excise Act.

Learned State counsel would oppose the prayer for grant of bail. 4.

Considering the entire facts situation of the case, this Court is inclined to release the applicants on bail. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.25,000/- with one surety each for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
