The applicant has preferred this bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.129/2018 registered at Police Station D.D. Nagar, Raipur, District Raipur (CG), for the offence punishable under Sections 302, 34, 120-B of the Indian Penal Code. 2.

As per the prosecution case, the applicant is cousin of Prakash Sharma (since deceased). This applicant with other co-accused persons hatched a conspiracy of stage drama of

MCRC No.9494 of 2020 kidnapping of deceased and thereafter seeking ransom of Rs.2.0 crores from his father, who happens to be the applicant's uncle. In execution of the said conspiracy, the applicant and other accused persons administered chloroform and tide the deceased because of which he died. 3.

Learned counsel for the State, per contra, would oppose the bail application.

Considering the nature of allegations and the material available on record, I am of the opinion that present is not a fit case to release the applicant on regular bail. 5.
