The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.284/2016 registered in Police Station Chouki Basdaei, Surajpur Distt. Surajpur (C.G.) for offence punishable under section 306 of Indian Penal Code. 2.
As per the prosecution, in the intervening night of 26-27/03/2016 the deceased Lokmani committed suicide by hanging. Subsequently, on investigation it was revealed that the applicant was having love relation with the deceased whereby the deceased became pregnant and thereafter applicant refused to marry, therefore the applicant abetted the deceased to commit suicide.

Learned counsel for the applicant submits that on presumption the applicant has been inculpated, there is no direct evidence against the applicant that he has abetted the deceased to commit suicide. He further submits that statement of the father of the deceased Jwala Prasad also do not attribute any allegation of abetment against the applicant, charge
sheet has been filed, therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Perused the statement of father of deceased namely Jwala Prasad. Considering the facts and circumstances of the case, charge sheet has been filed, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
