1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 286 of 2016 registered at P.S. Surajpur, Distt. Surajpur (C.G) for the offence punishable under Sections 452, 323, 506, 379 of IPC and Sections 25 & 27 of the Arms Act.

2. As per the prosecution case, on 29.06.2016 the applicant entered into the house of complainant with sword. When he was spotted and objected the applicant abused the complainant and tried to strangulate whereby the complainant fell down. Subsequently two of the persons who were sitting in the house came to the rescue of complainant and at that time the applicant while leaving took away the wrist watch and Rs.1700/- and a mobile and left the spot, thereby the offence is committed.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated and some monetary dispute was existing between the present applicant and the

complainant, therefore, false allegations have been leveled against the applicant. He prays that under the circumstances, the applicant may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail and would submit that as many as another six cases under different section of IPC were registered against the applicant between the period from 2012 to 2016.

5. Perused the statement of the victim as also the documents.

6. Taking into consideration the antecedents of the applicant as six cases are pending against the applicant under different sections of IPC and Cr.P.C., I am not inclined to release the applicant on bail. Accordingly, it is rejected. Sd/- GOUTAM BHADURI JUDGE R a o
