1. The applicants have preferred this bail application for grant of bail as they are arrested in connection with Crime No.173/2017 registered at Police Station Urla, District Raipur for offences under Sections 294, 323, 354Kh/34 of the IPC.
2. Considering the statement of the prosecutrix as also on account of previous antecedents of applicant No.1 - Lokesh Baghel of committing similar nature of crime, prayer for bail moved by applicant No.1Lokesh Baghel and applicant No.3 - Rakesh Baghel, is rejected at this stage. They may repeat their prayer after examination of any one of the
prosecutrix/victim.
3. Insofar as applicant No.2 - Bhoj Raj Baghel is concerned, he came to the spot after the first part of the incident was over, therefore, even if allegation of tearing clothes of the prosecutrix on this applicant, the same might had happened during manhandling and he does not appear to have any intention to outrage the modesty of the prosecutrix.
4. Accordingly, applicant No.2 - Bhoj Raj Baghel is entitled for bail. The application in respect of this applicant is allowed and he is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
