Shri K. K. Shrivastava, counsel for the respondents. Today when the matter is taken up at admission stage, counsel appearing for the respondents produces an order dated 10.09.2019 passed by the disciplinary authority inflicting the petitioner with an order of dismissal from service.

Given the fact that the final order dated 10.09.2019 has already been passed and the challenge in the writ petition is to the inquiry report and the consequential second show cause notice issued to the petitioner, the writ petition as such rendered infructuous. The subsequent order dated 10.09.2019 which is a final order passed now would have to be challenged in accordance with the remedies available under the service rules as also under the legal system.
