1. Heard.

2. The present petition has been brought being aggrieved by the order dated 29.09.2021, passed in the appeal before the respondent no.2 upholding the order of Naib Tehsildar by which the Naib Tehsildar/respondent No.4 has proceeded against the petitioner to evict him from the property in question.

3. Heard the learned counsel for both the parties.

-24. The impugned order is appealable and the petitioner had remedy available to file appeal before the Collector/respondent No.2. Therefore, this petition is disposed off at the motion stage. The petitioner is granted liberty to file appeal against the impugned order before the Collector, District- Mahasamund. Liberty is granted to file appeal within a period of 15 days from today and then the respondent no.2 is directed to hear and decide the appeal at the earliest until the period of 60 days. The eviction proceeding, if any, is continuing shall remain stayed for a period of 15 days only. This order of stay shall stand automatically vacated after 15 days from today.
