The applicant has preferred this bail application under Section 439 CrPC, as he has been arrested in connection with Crime No.426/2016, registered at Police Station Sirgitty, District Bilaspur for the offence punishable under Sections 363, 366, 376 of IPC and Section 3 & 4 of POCSO Act. 2.

Although, there appears to be consent of the prosecutrix in making relation with the applicant, however, considering the fact that the applicant has enticed the girl and took her to Delhi and other places without ascertaining as to whether

the prosecutrix has attained the age of majority, no case for release of the applicant on bail is made out at this stage. 3.

Accordingly, the bail application is dismissed. The trial Court is directed to expedite the trial.
