Grievance of the petitioner in the present writ petition is the order of transfer, dated 10.9.2018, Annexure P-1, which has been issued against the petitioner.

The petitioner being a lady has been sent from Pendra, District Bilaspur to Sankargarh, District Balrampur.

The only substantive ground raised by the petitioner in the present case is that the spouse of the petitioner is also a Lecturer of Maths subject and is posted at Government Girls Higher Secondary School, Gourela, District Bilaspur.

According to the petitioner, the transfer policy itself has a clause where the authorities concerned would have to consider the case of transferring of a person whose spouse is in government employment as far as possible in the same station.

Given the said facts, let the petitioner make a detailed representation in this regard in addition to the representation which he has already made, within a period of 10 days from today. Let respondents no. 1 and 2 take a decision on the said representation at the earliest preferably within a period of two months.

Meanwhile, the impugned order of transfer shall not be given effect to so far as the petitioner is concerned.
