Complainant - Lamturam and prosecutrix both are present before this Court and they are making statement of no objection in grant of bail to the applicant.

First bail application of the applicant M.Cr.C. No.883/2020, was dismissed as withdrawn by order dated 06.08.2020 and the second bail application M.Cr.C. No. 7951 of 2020 has been decided on merits on 14.12.2020 and dismissed. The prosecutrix in that proceeding had raised objection in grant of bail to the applicant. Hence, under these circumstances, the prosecutrix can not be allowed to change her statement for present bail application.

After arguing for sometime, the learned counsel for the applicant seeks permission of this Court to withdraw this instant bail application filed

under Section 439 of Cr.P.C. and also seeks direction from this Court for expeditious trial.

It is ordered as prayed for.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed as withdrawn with the liberty as aforesaid. The trial Court is also directed to expedite the trial and conclude the same as early as possible preferably within a period of four months from the date of this order.
