Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 22/11/2021 Heard on admission as also I.A.No.1/21, application for grant of interim relief. 2.

Shri Pandey, learned counsel for the petitioner would submit that he has been posted at Tahsil - Balrampur only vide order dated 13/07/2021 and in compliance of which, he was relieved on 16/08/2021 and then and amended transfer order was issued on 24/08/2021. Now, the petitioenr has been transferred from Tahsil -

Balrampur to Revenue, Wadrafnagar. Even otherwise, there is no administrative exigency for transfer within a short period, for which, the petitioner may be allowed to make representation Collector - Balrampur within 7 days from today and meanwhile, he may not be relieved from the present place of posting. 3.

Learned State counsel opposes the prayer.

I have heard learned counsel for the parties. 5.

The petitioner has been transferred from Tahsil - Balrampur to the office of Sub-Divisional Officer, Revenue, Balrampur. It would be expedient to direct the petitioner to make representation to the Collector, Balrampur within a period of 7 days from today and the representation shall be decided by the Collector by a reasoned order within a period of 2 weeks from the date of receipt of representation. For a period of 3 weeks, the impugned order (Annexure P/1) shall not be given effect to.

With the aforesaid observations, this petition is finally disposed off. Certified copy as per rules.
