1. The challenge in the present Writ Petition is to the impugned order Annexure P-1 dated 23.08.2019, whereby the petitioner has been transferred from District: Bilaspur to Balrampur, (C.G.)
2. The contention of the petitioner is that, he from a schedule area on his own request was transferred to a non-scheduled area on his own expenses. The petitioner was transferred on his request to Bilaspur
-2vide order Annexure P-4 dated 22.09.2018. However, though the order was passed in September, 2018 the petitioner was relieved to join at Bilaspur only in January, 2019 (Annexure P-5).
3. Now, in less than 8 months of time, the petitioner has been again transferred to a scheduled area. According to the petitioner, the petitioner has already working in scheduled area in the past till 2018 when at his own request, he has been sent to Bilaspur and within a short span of time, in less than 8 months he has been again sent to another scheduled area.
4. It is also contended that the petitioner is an office bearer of Chhattisgarh Khadya Apurti Nirishak Sangh.
5. With the aforesaid reasons, considering the fact that he is transferred on his own expenses.
6. Let the petitioner make a detailed representation to the respondents within a period of 10 days from the receipt of copy of this Order and the respondents in turn shall consider the same within a further period of 45 days from the date of receipt of representation of the petitioner.
7. Till the representation of the petitioner is decided, there shall be stay of the effect and operation of the impugned order including any relieving, if any passed.
8. With the aforesaid observations, the present Writ Petition stands disposed off.
