Hon'ble Shri Justice P. Sam Koshy Order On Board 03.09.2019

1. The challenge in the present writ petition is to the order Annexure P-1 dated 21.08.2019 whereby the petitioner has been transferred from the Office of Block Education Officer, Baloda, District Janjgir-Champa to the Office of Block Education Officer, Bemetara, District Bemetara.

2. The ground on which the petitioner has sought for interference with the impugned order is personal ground inasmuch as the wife of the petitioner is suffering from certain mental illness and is under constant treatment and she is also living with her parents at Janjgir. Counsel for the petitioner submits that at this juncture transferring the

petitioner to a different place would cause great difficulty to attend his ailing wife.

3. Given the aforesaid facts, let the petitioner make a detailed representation to the respondents within a period of 10 days from today and the respondents in turn shall consider the same within a further period of 45 days from the date of receipt of the representation.

4. Till the representation of the petitioner is decided, the effect and operation of the impugned order so far as the petitioner is concerned shall remain stayed.
