2. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 35/2017, investigating agency- Excise Circle Kawardha, Distt. Kabirdham (CG) for offence punishable under Section 20(b)(II)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (in brevity 'NDPS Act').
3. Learned counsel for the applicant submits that charge sheet has not been filed, the applicant is remanded by the Special Judge under NDPS Act, Kabirdham, CG. This is his first bail application before this Court. He is first offender. The applicant has been falsely implicated. He is innocent. He is permanent resident of Distt. Kabirdham. As per allegation, from the applicant, 5 kg Ganja has been seized. He will not commit any offence in future if granted bail. He may be granted bail as the trial may take
some time.
4. Per contra, learned State counsel opposes the arguments advanced on behalf of the applicant on the basis of the quantity of the ganja so seized from the applicant.
5. Perused the matter.
6. After consideration of the quantity of Ganja so seized from the applicant and other connected facts, I am not inclined to grant bail to the applicant.
7. Consequently, instant MCRC is dismissed.
