1. The present Contempt Petition has been filed alleging non-compliance of the Order dated 15.03.2019 passed in WPS No. 1774 of 2019.

The direction by this Court was to the respondent to consider the case of the petitioner/applicant for promotion from the post of senior clerk to the post of Inspector after giving proper seniority to the petitioner/applicant on the cadre of senior clerk and compare his case with the other similarly placed persons; so far as promotion is concerned. The respondent has filed his reply, in the reply he has also enclosed a document Annexure R-6 which is the minutes of the meeting of the review DPC that was held on 11.10.2019. According to the said committee, the petitioner/applicant has been found eligible for promotion after his seniority was rectified but for want of vacancy on the promotion post, the case of the petitioner/applicant could not be

-2considered. According to the counsel for the respondent, subsequent to the seniority of the petitioner/applicant having been rectified, many of the persons who were earlier wrongly granted promotion, orders have been passed for demoting them also.

3. Given the said facts by the counsel for the respondent and the document enclosed along with the reply, this Court is of the opinion that the order passed by this Court stands duly complied with. However, in the event, if the petitioner/applicant is still aggrieved of the decision taken by the respondent, he would be at liberty to challenge the same by way of a fresh proceeding.
