The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.190/2016 registered in Police Station Jashpur, District Jashpur (C.G.) for offence punishable under sections 456, 354 of Indian Penal Code.

As per the prosecution case, a report was made that on 28/08/2016 at about 4 am the applicant entered into the hostel went to the room of the victim, tried to pull away the blanket and having raised alarm, the applicant wanted to fled away and he was caught hold of. Thereby, offence has been committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and he was resident of same locality. He submits that the incident has been committed by some other person, charge sheet has been filed, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case, degree of allegation and also for the fact that charge sheet has been filed, this court

is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
