The applicant has preferred this bail application, as he has been arrested in connection with Crime No.125/2017, registered at Outpost Saket, Police Station Pathariya, District Mungeli for the offence punishable under Section 304B of IPC. 2.

The applicant is husband of deceased Shashi Nirmalkar, who died after suffering burn injuries on 08.05.2016. 3.

It is argued that the FIR has been registered on 31.03.2017 i.e. after about 9 months from the date of incident, therefore, the prosecution case is false and concocted.

Apart from the regular case diary, this Court also summoned the case diary of merg enquiry, which contained statement of mother of the deceased recorded on 08.05.2016 making allegation that the applicant used to demand motorcycle and mobile and due to this cruelty, her daughter Shashi Nirmalkar committed suicide. 5.

Considering the quality of evidence against the applicant, this Court is not inclined to release him on bail. Accordingly, the bail application is dismissed.
