1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.78/2017 registered at Police Station Bhanupratapur, District North Bastar, Kanker for offence under Sections 9, 39, 44, 49, 49(B), 51 and 52 of the Wild Life Protection Act, 1972.
2. On a secret information the concerned police intercepted co-accused Mahattam Dahibale and recovered one leopard skin from him. Present applicant Puneetram was accompanying Mahattam Dahibale, therefore, from him, his motorcycle has been recovered. On the basis of statement made by Mahattam Dahibale, the police also enquired from Chenlal and Santosh upon which Chenlal made disclosure statement leading to recovery of tiger skin from his house.
3. Considering the fact that seizure of leopard skin or tiger skin has not been made from this applicant; he is in jail since 28.5.2017 and the offence is triable by the JMFC, this Court is inclined to release him on bail.
4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
