On the submissions made by the counsel for the petitioner that he would not be relying upon the documents which have been held to be faint by the Registry for which the matter has been listed for default, the matter is taken for hearing on admission.

The grievance of the petitioner in the instant case is the delayed grant of promotion as compared to his juniors who was granted almost 10 years earlier. According to the petitioner he was initially appointed as Shiksha Karmi Grade-III as early as in 1998 and on completion of probation period he stood regularized in service in 2002. According to the petitioner he became entitled for promotion on completion of satisfactory service for a period of 7 years on the post of Shiksha Karmi Grade-III. That he has completed 7 years of regular service wayback in the year 2005 itself. However, the petitioner could get the promotion only in the year 2016 as Shiksha Karmi Grade-II.

According to the petitioner recently he came to know that juniors to the petitioner particularly one Shri Niranjan Sahu who was appointed much after the petitioner was appointed as Shiksha Karmi Grade-III got his promotion as Shiksha Karmi Grade-II immediately on completion of 7 years of service vide order dated 02.06.2006. According to the petitioner when he came to know about this fact he immediately made a representation to the authorities in the department. The District Education Officer District Rajnandgaon on due scrutiny of his records found that petitioner seem to have been wrongly denied promotion earlier and vide Annexure P-6 dated 01.05.2019 has recommended to the Joint Director for granting promotion to the petitioner w.e.f. 02.06.2006 and also for providing proper seniority on the said post. However, there does not seem to be any further development thereafter. 4.

The limited relief that petitioner at this stage asks for is for appropriate direction to the respondents no.2 to 5 to take appropriate steps in case of the petitioner so far as grant of seniority and promotion w.e.f. 2006 onwards in the light of the correspondence of the respondent no.5 dated 01.05.2019 (Annexure P-6).

Let a decision be taken by the respondents no.2 to 5 in this regard at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.
