1. Present MCC has been filed seeking restoration of F.A.M. No. 240/2016 which was dismissed by peremptory order dated 08.07.2021.

2. On due consideration, taking note of the nature of dispute and considering contentions put-forth by the applicant, a strong case for allowing MCC is made out.

3. Accordingly, MCC stands allowed and F.A.M. No. 240/2016 is restored to its original number, subject to the applicant curing defect of non-filing of paper book within a further period of four weeks.
