This is the second bail application under Section 439 of Cr.P.C. The earlier bail application was dismissed on 21/06/2016 in M.Cr.C. No.2626 of 2016.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.259/2016 registered in Police Station Durg for offence punishable under sections 294, 506, 323, 295 of Indian Penal Code.

As per the prosecution case, on 24/03/2016 at about 8 O' clock, the applicant entered into a temple of Lord Bajrangbali and abused the Priest, the complainant and placed his foot over the Hawankund and thereby has committed the offence.

Learned counsel for the applicant submits that the applicant is in jail since 24/03/2016, therefore the applicant may be released on bail. 5.

Learned State counsel submits that all the prosecution witnesses have been examined and case is fixed for orders. 6.

In view of the submission made by the State counsel, it would not

be proper for this court to entertain this second bail application at the fag end of the trial.
