1. The applicant has been arrested in connection with Crime No.106 of 2017 registered in Police Station- Khadgawa, District- Koriya (C.G.) for alleged commission of offence under Section 419, 420 IPC.

2. Case of the prosecution, in brief, is that in the name of providing employment, the applicant recovered Rs.35,000/- from three complainants.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated and there is no concrete proof of she having taken any money from the complainants and the complainants, in order to falsely implicate for oblique reasons, have made certain allegation. Learned counsel for the applicant further submits that the investigation is complete and charge sheet has been filed and the applicant is having 2 year's old child in her lap, therefore, in these circumstances, she may be granted bail.

4. On the other hand, learned counsel for the State, opposing the bail

-2application, submits that from the statement of three complainants, prima facie, a case is made out against the applicant. Therefore, she is not entitled to grant of bail.

5. Having considered the submissions made by learned counsel for the parties, considering the material on record and further considering that the investigation is complete and charge sheet has been filed, the application is allowed.

6. It is directed that the applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- along with one local surety for the like amount to the satisfaction of the concerned trial Court, with following further conditions:

(i) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial; and (ii) The applicant shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. Certified copy as per rules.
