1. Mahesh Sahu S/o Ramdayal Sahu, Aged About 50 Years R/o Village Bhothli, Police Station Patan, District Durg (Chhattisgarh). ---- Petitioner Vs
1. State Of Chhattisgarh Through The Station House Officer Police Station Amleshwar, District Durg (Chhattisgarh) ---- Respondent For Applicant Shri Goutam Khetrapal, Advocate For Respondent/State Shri Sangarsh Pandey & Shri Adiraj Surana, Dy. Govt. Advocate Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 04/12/2017 1.
The applicant has preferred these applications filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.132/2016 & 133/2016 registered in Police
Station Amleshwar, District Durg, for offence punishable under Sections 420, 467, 468, 471 & 120-B of the Indian Penal Code and Section 3 (4) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989.
2.
Although the applicant is in jail since 21-4-2017 for two crimes alleging forgery, cheating and concoction of document in relation to the land owned by Sukhau & Bukau and the offence is triable by the Judicial Magistrate First Class, however, the applicant appears to be habitual in committing offence relating to forgery as another two cases bearing Cr.No.93/2017 & 109/2017 for offence under Section 420 of the IPC are registered by the concerned SHO against the applicant, it is not a fit case to release the applicant on bail. 3.
Accordingly, both the bail applications are rejected. Sd/- Judge Prashant Kumar Mishra Gowri
