1. The present Contempt Petition has been filed alleging noncompliance of the Order dated 10.04.2019 passed in WPS No. 2705 of 2019.

2. The direction of this Court was for releasing of the petitioner's provident fund lying to his credit with the respondents, subject to the petitioner giving an undertaking as is required by the department in

-2the event of the appeal of the petitioner being allowed. At this juncture, the counsel for the petitioner/applicant submits that the appeal has since been decided and the same stands rejected.

3. The counsel appearing for the respondents submits that though the appeal stands rejected but the requirement of an undertaking would be still necessary, as there is likelihood of the petitioner/applicant challenging the order of termination before the higher authorities or even before the High Court and in the event, if there is an order of reinstatement of the petitioner, the respondents require an undertaking.

4. At this juncture, Shri Sushil Dubey, counsel appearing for the petitioner submits that, the petitioner is ready to give an undertaking and submits that petitioner shall submit the undertaking to the respondents within a period of 15 days from the date of receipt of copy of this Order. Accordingly, the Contempt Petition stands disposed of and the respondents are directed to consider and decide releasing of the provident fund amount due to the petitioner/applicant at the earliest, preferably within a period of 45 days from the date of receipt of the representation by the petitioner/applicant.

5. With the aforesaid observations, the Contempt Petition stands disposed-off.
