The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.223/2016 registered in Police Station Out Post-Karhi Bazar, P.S. City Kotwali, Balodabazar (CG) for offence punishable under sections 302, 201 of IPC. 2.

As per the prosecution case, on 12/06/2016 one Kalindri Bai wife of the applicant was reported to have been died by burn injury. Subsequently, in postmortem the burn injury was found to be post mortem and it was found that she died due to asphyxia. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and there is no evidence to this regard that the applicant has committed murder of his wife instead only on assumption and presumption the applicant has been inculpated, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary. Case diary shows that the report was made by the applicant and wife died because of the burn injury but postmortem

report is otherwise which shows that she died due to asphyxia. Considering the place of incident house of the applicant and the evidence which is available, this court is not inclined to release the applicant on bail. 6.
