The applicant has filed this revision against the order dated 5.7.2019, passed by the 7th Additional Sessions Judge, Bilaspur (CG) in Sessions Case No. 149/2016, wherein the Court below has rejected the application preferred by the applicant under Section 91 of the Cr.P.C. for calling CCTV Footage of Hotel Emerald, Telephone Exchange Road, Telipara, Bilaspur.

State has filed its reply supported with an affidavit of City Superintendent of Police, Civil Lines, District Bilaspur, in which, the City Superintendent of Police has stated that during investigation,
CCTV footage of Hotel Emerald, Telipara, Bilaspur was not seized by the Police.

Considering the affidavit filed by City Superintendent of Police, Civil Lines, Bilaspur, this revision petition has becomes infructuous. 5.
Accordingly, the revision is dismissed as having become infructuous. However, it is directed that if the applicant has deposited the fine of Rs.500/- imposed by the trial Court vide order dated 5.7.2019, the same shall be refunded to him at the earliest. The trial Court is directed to expeditious the trial. 6.
