The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.52/2016 registered in Police Station Mainpur, District Gariyaband (C.G.) for offence punishable under section 20(II)(B) of Narcotic Drugs and Psychotropic Substance Act, 1985.

As per the prosecution case, on 10/07/2016 on an information received that the applicants were travelling in a bus with illegal cannabis and on being intercepted from the posssession of applicant No.1 five kg and from applicant No.2 four kg of cannabis were recovered. 3.
Learned counsel for the applicants submits that the seizure was not made in person from the applicants and it was from the bus and one of the seizure witness has turned hostile, therefore the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the fact that from the possession of applicant No.1 five
kg and from applicant No.2 four kg of cannabis were recovered and also considering the evidence available against the applicants, this court is not inclined to release the applicants on bail.
