NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CRR No. 807 of 2017 • Panna Lal Yadav S/o Sundar Lal Yadav, Aged About 25 Years R/o Village Semarchuwa, Police Station Jarhagaon, District Mungeli Chhattisgarh. ---- Applicant

Versus

• State of Chhattisgarh Through The Police Station Jarhagaon, District Mungeli Chhattisgarh.

---- Respondent For Applicant :

Shri RK Dubey, Advoate For Respondent-State :

Shri Sangharsh Pandey, Dy. GA for the State Hon'ble Shri Justice Goutam Bhaduri Order On Board 23/08/2017

1. Heard.

2. Perusal of the documents filed along with the revision prima facie shows that the entire revision is misconceived.

3. Learned counsel for the applicant submits that during cross-examination in chief leading questions were asked to the witness, which were not permitted under Section 141 & 142 of the Indian Evidence Act and the objection which was raised has not been dealt with.

4. Perusal of the order and copy of deposition would show that the entire allegations has no merit. The court cannot compel a witness to answer the questions only in yes or no or in a particular way as the counsel for accused wants, it is for the witness to explain and the court at the end of the day has

to takeout the truth from it. At the behest of the applicant, the statement of the witness cannot be restricted. The revision has no merit. It is accordingly dismissed.
