The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.64/2016 registered in Police Station Bori, District Durg (C.G.) for offence punishable under sections 420, 467, 468, 471, 406 of Indian Penal Code.

As per the prosecution case, the applicant allured the complainant Rakesh Kumar Sahu to purchase the car with promise that it will be deployed as taxi in the Idea Company and after purchase of the car it was handed over to the applicant who in turn handed it over to one Vaibhav Deshmukh and on the basis of forged agreement car was alleged to be sold. Thereby, offence has been committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, recovery of the vehicle was made from Vaibhav Deshmukh and presently complainant has also obtained possession of the vehicle, no further investigation would be necessary, therefore in the facts of the case, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the facts and circumstances of the case, charge sheet has been filed and also considering the nature of allegations, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
