1. The challenge in the present Writ Petition is to the order (AnnexureP/1) dated 22/08/2019 whereby the services of the petitioner has been transferred from Assistant Engineer Pariyojana Kriyanwayan Unit-I At Raigarh to Assistant Engineer at District Durg.
2. The Contention of the petitioner is that he has been recently transferred from Bijapur to Raigarh vide (Annexure P-4) and in less than 6 months time, he again is being sent to a different place. According to the petitioner, he is a person with disabilities as is evident from disability certificate provided by the medical officer at Bilaspur dated 07.05.1986. He further submits that he is more than 60 years of age and only around 11⁄2 years of service is left for his superannuation.
3. Considering all the facts that the petitioner has raised, let the petitioner make a representation to the respondent No. 1 within a period of 10 days' from the date of receipt copy of this order and respondents in turn shall decide the representation within further period 45 days' from the date of receipt of representation of the petitioner.
4. Till the representation is decided, there shall be a stay of the effect and operation of the order so far as the petitioner is concerned.
