1. The challenge in the present Writ Petition is to the impugned order Annexure P-1 dated 27.08.2019, whereby the petitioner has been transferred from District Baster to District Dantewada, (C.G.).

2. The contention of the petitioner is that, the petitioner for the last many years has been posted in tribal and schedule area and as per the transfer policy of the State Government having worked in a scheduled area, the concerned employee/officer should have been considered/transferred to a non-scheduled area. Now, in the instant case, the petitioner before coming to Baster, was working in another scheduled area in Koriya, District: Koriya and now in less than about 2 years time, the petitioner has again been shifted from core

-2schedule area to another core schedule area, which is contrary to the schedule area policy of the State Government.

3. Given the facts and circumstances of the case, let the petitioner make a representation to the respondents within 10 days from the date of receipt of copy of this Order and the respondents in turn shall consider and decide the representation so made within a further period of 45 days from the date of receipt of representation of the petitioner.

4. Till the representation of the petitioner is decided, there shall be stay of the effect and operation of the impugned order, so far as the petitioner is concerned.
