1. It is submitted by counsel for the petitioner that the petitioner is a Self Help Group of District Janjgir-Champa and it has the work order for distribution of Ready to Eat Food in the Sector Kotmi of District JanjgirChampa. In the meeting held by District Level Committee on 22.7.2020, the decision was taken to cancel the work order for the sectors, namely, Jaijaipru, Odekera, Chisda, Kachanda, Hasauda, Thathari and Kotetara and it was also decided that fresh proposals shall be invited by publication of advertisement, which is reflected in the minutes of the

-2meeting filed as Annexure-P/3. It is further submitted that one of the Self Help Group, namely, Jai Satnam Mahila Swa Sahayata Samuh Bandhapali preferred W.P.(C) No. 1929 of 2020 on the basis of the grievance that the said Self Help Group was not awarded any contract. The petition was disposed off by the order dated 15.9.2020 directing the petitioner to prefer an appeal before the District Collector alongwith other directions to the District Collector.

Respondent No.3 referring to the order of the High Court in W.P.(C) No.1929 of 2020 and the minutes of the meeting dated 22.7.2020 ordered cancellation of the work order with respect to all the sectors. It is submitted that the impugned order passed by respondent No.3 is clearly erroneous in which the order of this Court had been misinterpreted and also the minutes dated 22.7.2020 has also been misinterpreted. The petitioners have filed a representation praying for review of the order dated 10.12.2020 (Annexure-P/3) but the same has not been considered by respondent No.3 so far, therefore, the petitioner has apprehension. Hence, it is prayed that the appropriate orders be passed.

3. Learned State counsel representing for respondents No.1 to 5 opposes the submissions and submits that the petition may be disposed off with a direction.

4. Considered on the submissions. Perused all the documents filed alongwith the petition. On perusal of the minutes of the meeting (Annexure-P/3), District Level Committee dated 22.7.2020, it is clearly found that no decision was taken by respondent No.5 regarding cancellation of the work order of the petitioner for Kotmi sector. Further, on perusing the order dated 15.9.2020 in W.P.(C) No.1929 of 2020, it is found that this Court had directed the petitioner to prefer an appeal

-3before the District Collector alongwith other directions and there is no other order which could have been interpreted in the manner, respondent No.3 has interpreted in passing the impugned order (Annexure-P/4). Hence, with these observations, the present petition is disposed off at motion stage.

5. Respondent No.3 is directed to consider on the representation filed by the petitioners within a period of 30 days from today and take a decision accordingly taking into consideration the observations made by this Court in this order.
