This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.161/2016, registered at Police Station - City Kotwali, Mahasamund, District - Mahasamund (C.G.) for the offence punishable under Section 420, 467, 468, 471, 34 of Indian Penal Code.

As per prosecution case, a report was made by one Chetan Kumar Thakur on 21.04.2016 alleging that on 18.06.2014, the applicant and the other co-accused in order to provide him job in the railway has demanded Rs.5,50,000/- and received an amount of Rs.3,50,000/-. Subsequently, he was taken to Calcutta and medical test was conducted. Thereafter, the joining letter was given, which was found to be forged. Thereby the offence has been committed.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and he himself is the victim. It is further submitted that initially the applicant has contacted one Rajesh Shrivastava to him the applicant has paid Rs.4,30,000/- and when he could not appoint, he assured the applicant to get the amount returned through himself or through some one else, consequently, different amount was transferred in the account of the applicant and total Rs.3,75,000/- was deposited in the account of the applicant. Therefore, the counsel prays that the applicant may be enlarged on bail.

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel appearing for the parties. 6.
Perused the case diary, documents, statement of Chetan Kumar Thakur, wherein allegations have been levelled that cash amount was also paid to the present applicant and other co-accused. Taking into such statement as the joint allegations have been levelled against the applicant, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
