1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 158/2016 registered at P.S. Kondagaon, Distt. Kondagaon (C.G) for the offence punishable under Sections 366, 368, 370/34 of IPC.
2. As per the prosecution case, a report was lodged by Hiraman that on 12.06.2016 his daughter had gone to Kondagaon and while coming back she met one Kalpana who was sitting in Bolero Vehicle. The victim was allured and thereafter she alongwith Kalpana went to Umarkot wherein this applicant Smt. Tina Vishwas @ Santoshi Madhu has also met. Subsequently, both the other accused took the girl to Basaigaji and for marriage sold her for Rs.30,000/- and left her in the house of one Mohan Lal to get the victim married to Charan Singh.
3. Learned counsel for the applicant would submit that the applicant has been falsely been implicated in this case and
there is no evidence on record to show that the applicant was involved in commission of crime and sold the victim and the main allegations are attributed to co-accused Kalpana, therefore, the applicant may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail.
5. Perused the case diary and documents as also the statement of victim which was recorded.
6. Considering the nature of allegations which shows that the victim was subjected to sale to the present applicant and other co-accused, I am not inclined to allow this bail application. Accordingly it is rejected.
