Grievance raised in this writ petition is that earlier order passed by this Court in WPS No.1039/2009 dated 02/03/2009 and WPS No.5273/2010 dated 13/09/2010 have not been complied with till date by Janpad Panchayat, Basna. 2.

When the matter is taken up in the first round, this Court directed learned State counsel to obtain instructions as to why the order has not been complied with.

On instructions, Shri Sunil Otwani, learned Addl. A.G. would submit that the petitioner may appear before the Chief Executive Officer and make fresh representation and furnish additional documents and the representation will be decided by the Chief Executive Officer, Janpad Panchayat, Basna within 30 days from the date of receipt of representation.

Be that as it may, respondents 3 and 4 are directed to consider and decide the representation of the petitioner within 30 days from the date of receipt of representation. The petitioner's eligibility also shall be decided in accordance with law.
