Hon'ble Shri Justice Arvind Singh Chandel Order On Board 05/12/2018

1. The applicant have preferred this first bail application under Section 439 of Cr.P.C. for grant of regular bail as they are arrested in connection with crime No. 6/2018, registered at Police Station - Bheji, District- Sukma (C.G.) for the offence punishable under Section 4(b) of the Explosive Substance Act.

2. As per prosecution story, on 22.06.2018, on the basis of information received from an informant that on the road from Bheji to Ellad Madgu suspicious persons are standing with a bag. On the basis of said information, police personnels went to the spot and when the applicants tried to flew away they were arrested by the police, on being searched by the police, they have found gelatin pencil cell, detonator, electric wire, steel tiffen, battery etc. On the basis of above,

offence has been registered against the present applicants and they have been arrested on the same date.

3. Learned Counsel appearing on behalf of the applicants submits that the applicants are innocent and have been falsely implicated in the case. He further submits that the applicants are in custody since 22.06.2018 and trial will take some time. Therefore, they may be released on bail.

4. Per contra, learned Counsel appearing on behalf of the State opposes the bail application.

5. I have heard learned Counsel for the parties and perused the case diary with due care.

6. Considering the facts and circumstances of the case, the evidence collected by the prosecution and looking to the grievous nature of crime, I am not inclined to release the applicants on bail.
