1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.349/2017, registered at Police Station : Mahasamund, District Mahasamund for offence under Section 306/34 of the IPC.
2. The applicant's wife committed suicide for the reason that after 6 years of their marriage, the applicant developed illicit relations with one Shikha Sahu.
3. Learned State Counsel would oppose the prayer for grant of bail.
4. Conduct of the applicant may be immoral but it is debatable as to whether such act or conduct would amount to abetment punishable under Section 306 of the IPC.
5. Considering the fact that the applicant is in jail since 10.8.2017, this Court is inclined to release the applicant on bail.
6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
