The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.278/2017 registered in Police Station Kotwali District Rajnandgaon (C.G.) for offence punishable under section 457, 380 of the IPC.

Case of the prosecution, in brief, is that a report was made by one Rupendra Sahu that theft has taken place in his house and gold ornaments and cash were looted. Subsequently the applicant was apprehended and from his possession certain ornaments were seized which were identified by the complainant.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, though the ornaments which is alleged to have been of the complainant belong to the applicant himself, he is in jail since 14th May, 2017, therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail and would submit that six cases of the different nature are to the credit of the applicant.

Perused the case diary and the documents. Case diary also contains identification memo. All the goods were identified by the complainant's wife. Considering the same and the past antecedents, this court is not inclined to release the applicant on bail. 6.
