It is submitted by the learned counsel for the petitioner that the petitioner is Woman Self Help Group engaged in manufacturing and supply of the ready to eat food. The applications have been invited by the respondent No.5 for the allotment of the work regarding supply of ready to eat food. The petitioner society has submitted application, however, the marking that has been made according to the scheme of marking vide Annexure P-3 is fully arbitrary and unreasonable. The respondent No.6 has been given highest marks, whereas, the respondent No.6 does not qualify for

receiving any marks as given. The petitioner earlier filed an objection on 23.08.2021, which has been rejected by the respondent authorities. It is submitted that respondent No.5 is proceeding to finalize the process of allotment in illegal and arbitrary manner, therefore, appropriate direction be issued.

Learned State counsel appearing on behalf of respondent No.1 to 5 opposes the petition and the submissions made in this respect. It is submitted that process of allotment of work order has not been finalized so far. The petitioner has opportunity to raise objection again and it will be only after the decision of the objection, the process shall be finalized. Hence, appropriate orders be passed.

Considered on the submissions and perused the documents placed on record. The petition is disposed off at motion stage. The petitioner is granted opportunity to file fresh objection within a period of 10 days from today and on filing of such objection by the petitioner, before respondent No.5, the respondent No.5 shall be obliged to consider on the objection filed by the petitioner and take decision on the same within a period of 15 days from the date the objection is received. It is also ordered that until the objection filed by the petitioner is decided by the respondent No.5, the process for allotment of work order with respect to supply of ready to eat food shall not be finalized. It is made clear that no observation has been made on the merits of the case.
