1) First bail application of the applicant u/s 439 of CrPC was dismissed on merit by this Court vide order dated 01.02.2021 passed in MCRC No. 9300 of 2020.
2) The applicant has preferred this Second Bail Application under Section 439 of Code of Criminal Procedure, 1973 as he is in jail since 12.09.2020 in connection with Crime No.359/2020, registered at Police Station- Bhatapara Urban, DistrictBalodabazar- Bhatapara (C.G.) for the offence punishable under Sections 294, 506, 307 & 34 of IPC and Sections 25 & 27 of Arms Act.
3) After arguing for sometime, learned counsel appearing for the applicant seeks to withdraw this application with liberty to repeat her prayer for bail by filing a fresh application, if the trial is not concluded within a period of 6 months from today.
4) Counsel for the State has no objection to the above prayer.
5) Permission granted.
6) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
