Considering note-sheet dated 29.04.2014 of the court below and also taking into consideration the contents of the sale deed, this court is of the opinion that arguable point has been raised by the appellant seeking for leave to appeal against the judgment of acquittal dated 21.07.2016 passed by the Judicial Magistrate First Class, Raipur in Complaint Case No.789/2012. Accordingly, the present petition is allowed. Registry is directed to register this case as an Acquittal Appeal.

The Acquittal Appeal is also admitted for hearing. On payment of PF within 10 days, let notice be issued to the respondents by usual mode mode as well as by registered mode.
