1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 262/2017 registered at Police Station Ganj Raipur, (C.G) for the offences punishable under Sections 364, 341 of IPC.

2. As per the prosecution case, a report was made by one Suman Sagar Sinha that he was called by one Pawan Pathak to purchase certain land. When he reached to Green Tea Hotel, alongwith others, thereafter few of the persons joined him on the pretext of purchase of land. He was subsequently kidnapped in a car and a ransum of Rs.10 lakhs was demanded from the father of victim on 12.07.2017. Thereafter the money of Rs. 7 lakhs as demanded was given at about 3.30 p.m., on 12.07.2017. Subsequently the report was made in the night of 13.07.2017.

3. Learned counsel for the applicant submits that no reason has

been assigned as to why the delay has occurred. He further submits that no recovery has been made from the applicant and only a dispute was there between few of the persons about the gambling and such dispute was given colour of kidnapping. He further submits that the narration as has been made is completely improbable and one of the memorandum witness has been examined and he has not supported the case of prosecution, therefore, the applicant may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application.

5. Perused the statements of victim Suman Sagar Sinha and his father Ganesh Kumar Sinha. Considering such statements, I am not inclined to allow this bail application. Accordingly, the bail application is rejected.
