The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.166/2021 registered in Police Station Rajhara, District Balod (C.G.) for offence punishable under sections 294, 354, 506 of Indian Penal Code and Section 7 and 8 of the Protection of Children from Sexual Offences Act, 2012. 2.

As per the prosecution case on 27/05/2021 the applicant tried to outrage the modesty of the victim/girl and abused her and she was minor, thereby offence is committed.

Learned counsel for the applicant submits that the victim has been examined and she has not supported the case of the prosecution, therefore the applicant may be released on bail. 4.

The girl/victim alongwith her father appeared through video conferencing from DLSA Balod and submitted that the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 6.

Perusal of the statement of the victim would show that she has not

supported the case of the prosecution. Having regard to the same and no objection has been made to the grant of bail, therefore this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
