1) The present appeal i.e. CRA No. 1431 of 2021 and previously filed appeal CRA No. 1217 of 202 1 are arising out of the same judgment of conviction and order of sentence dated 30.09.2021 passed by the Fifth Additional Sessions Judge, Bilaspur (C.G.) in Sessions Trial No. 44/2019. Previously filed appeal i.e. CRA No. 1217 of 202 has been preferred by the appellant namely Mohammad Mustakim @ Sohail through his counsel Shri Vikas Kumar Pandey, Advocate whereas subsequent appeal i.e. CRA No. 1431 of 2021 is filed on behalf of same appellant through his counsel Shri S. S. Baghel, Advocate. Since two appeals against the same judgment of conviction and sentence are not maintainable, in the facts and circumstances of the case, the appeal i.e. CRA No. 1431 of 2021 is dismissed as not maintainable.

2) List CRA No. 1217 of 202 1 for hearing in its due course.
