The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.248/2011 registered in Police Station Chirmiri, District Korea (C.G.) for offence punishable under sections 341, 147, 148, 149, 307 of Indian Penal Code and Section 25, 27 of Arms Act.

It is a case of bail jump. The applicant was enlarged on bail in the year 2011. Thereafter, on 8/07/2014 the applicant remained absent and as such arrest warrant was issued against the applicant. Subsequently, applicant was arrested in Crime No.493/2008 on 20/06/2016 wherein applicant was produced on the basis of production warrant and he has been arrested.

Learned counsel for the applicant submits that the applicant has settled down at Raipur and he could not make himself available and he was arrested in another case, it being the first time applicant may be extended benefit of bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents. Considering the facts and circumstances and the fact that applicant has already been arrested and he is in custody since 20/06/2016. Taking into detention of the applicant in jail and the fact that applicant was earlier enlarged on bail, this court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
