The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.253/2017 registered in Police Station Khamtarai, District Raipur (C.G.) for offence punishable under section 307/34 of IPC & under section 25, 27 of Arms Act. 2.

Case of the prosecution, in brief, is that over a dispute present applicant alongwith other has assaulted Vicky @ Manish Giri and five stab injury was given on the different parts of the body. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and on a trivial issue the incident happened, there was no intention to kill, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the victim and the dying declaration. Considering the dying declaration of the injured Vicky and also considering the statement of eye witness, this court is not inclined to

release the applicant on bail.
